Vorwerk, manufacturer of Thermomix beginning a legal battle against Lidl for the great resemblance to its products.
Vorwerk condemned the supermarket chain for violating Thermomix’s patent with its Monsier Cuisine robot, winning the court battle. This led to that the Lidl robot be prohibited from being marketed.
The Lidl chain defended that its robot did not violate intellectual property rights of Vorwerk for what he fought for the judge to annul the Thermomix patent for “lack of novelty” and for “lack of inventive activity”.
After months of legal proceedings, the Barcelona Court has ruled out that Lidl violates the Thermomix patent. This means that the German supermarket chain can once again sell its Monsier Cuisine food processor at Lidl.
In the sentence they focused andn components and security mechanisms of both robots while the machine works. “ANDThe kitchen robot of the defendant (Lidl) does not reproduce that necessary sequence so that it is possible to intervene safely in the shaker vessel”, since “the lid can be opened without the need for any previous action, that is, without the need for stop the stirring mechanism beforehand”, as in the Thermomix. This has been key to demonstrating that Monsier Cuisine has not copied the system, since it does not have the security measures that Thermomix has.
At the moment the initial ruling in which Lidl was convicted of patent infringement is annulled, but Vowerk can appeal to the Supreme Court.
